Terms of Service
1. Acceptance of terms
By creating an account or using KcalScan (the app on Android, the web app, and this website), you agree to these terms. KcalScan is operated by Tiago Fernandes ("we", "us"). If you do not agree, please do not use the service.
2. The service — and what it is not
KcalScan provides AI-powered nutrition tracking: photo-based estimates of calories, macronutrients and micronutrients, personalized targets, supplement tracking, wearable integration, and an AI coach.
3. Your account
- You must be at least 16 years old to create an account and use KcalScan.
- Provide accurate information and keep your sign-in credentials confidential.
- You are responsible for activity under your account.
- The service is intended for personal, non-commercial use.
4. Plans, subscriptions, and billing
- KcalScan offers a free tier and paid subscriptions (Gold and Platinum, monthly or yearly). The features and prices of each plan are shown at the point of purchase; AI-powered features require a paid plan.
- Billing is handled by Google Play (Android purchases), Apple's App Store (iPhone purchases), or Stripe (web purchases). Subscriptions renew automatically until cancelled.
- Free trials convert into a paid subscription at the end of the trial unless you cancel before it ends.
- Cancelling takes effect at the end of the current billing period: in your Google Play subscription settings, in your Apple ID subscription settings, or in the web billing portal (Settings → Manage subscription).
- Introductory and promotional prices (for example a discounted first year, or referral offers) apply for the stated period and then renew at the regular price. Promotions have their stated conditions and may change or end.
- Refunds: purchases via Google Play or the App Store follow that store's refund policy. For web purchases, contact us at tiago@kcalscan.app. Your statutory consumer rights, including those under EU law, are unaffected.
- Price changes are announced in advance and take effect from your next renewal, always with the option to cancel first.
5. Fair use
AI features are rate-limited to keep the service fast and affordable for everyone. Automated access, scraping, bulk requests, or attempts to circumvent limits, authentication, or plan restrictions are not permitted.
6. Your content
Your meal photos, logs, and profile data remain yours. You grant us the limited license needed to operate the service — storing, processing (including AI analysis as described in the Privacy Policy), and displaying your data back to you. You can export or delete your data at any time in Settings.
7. Intellectual property
The KcalScan app, website, branding, and content (excluding your data) are our property and protected by copyright and other laws. You may not copy, modify, resell, or reverse engineer the service, except where the law expressly permits it.
8. Disclaimers and limitation of liability
The service is provided "as is". AI estimates vary in accuracy and depend on what is visible in a photo; we do not guarantee any specific accuracy, outcome, or uninterrupted availability.
To the extent permitted by law, we are not liable for indirect or consequential damages, and our total liability for claims connected to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your mandatory statutory rights as a consumer.
9. Termination
You can stop using KcalScan and delete your account at any time in Settings. We may suspend or terminate accounts that breach these terms (for example, abuse of AI endpoints or payment fraud). Where we terminate without such cause, active paid periods are honored or refunded pro rata.
10. Governing law
These terms are governed by Portuguese law. If you are a consumer in the EU, you also keep the protection of the mandatory rules of your country of residence, and you may bring disputes before your local courts.
11. Changes to these terms
We may update these terms; the date above reflects the latest version. For significant changes we will notify you in the app or by email, and continued use after the change means acceptance.
